These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Island Signal Radio ("ISR," "we," "us," or "our"), a property of 3ON Entertainment Group. These Terms govern your access to and use of our website located at isr.3onent.com, our live internet radio streaming service, and all related services, forms, and features (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing, browsing, or using the Island Signal Radio website or streaming service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use our Service. Your continued use of the Service following any modifications to these Terms constitutes your acceptance of the updated Terms.

2. Description of Services

Island Signal Radio provides the following services through its website and associated platforms:

• Live internet radio streaming of music, talk shows, interviews, and cultural programming, available 24 hours a day, 7 days a week
• A music submission portal through which artists may submit tracks for airplay consideration
• A "Get Featured" program through which artists and content creators may apply for on-air features, interviews, and promotional opportunities
• Advertising services for businesses and brands seeking to reach the ISR audience
• An email newsletter and content distribution service for subscribers
• A contact and inquiry portal for general correspondence

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. ISR shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

3. User Eligibility

The Service is intended for users who are at least 13 years of age. By using the Service, you represent and warrant that you are at least 13 years old. If you are between 13 and 18 years of age, you represent that you have obtained consent from a parent or legal guardian to use the Service and agree to these Terms. Users under 13 are not permitted to use the Service. ISR reserves the right to terminate accounts or access for users found to be under the minimum age requirement.

4. Use of the Service

Permitted Use

You may use the Service for your personal, non-commercial use to listen to our live radio streams, access programming information, submit music, inquire about advertising, and communicate with our team. You may share links to our website and streams through social media and personal communications.

Account & Form Submissions

When submitting any form on our website — whether a contact form, music submission, feature application, or advertising inquiry — you agree to provide accurate, current, and complete information. You are responsible for maintaining the accuracy of any information you submit. Providing false, misleading, or fraudulent information is grounds for immediate rejection of your submission and may result in being permanently barred from using our Service.

5. Intellectual Property

ISR Content

All content on the Island Signal Radio website, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, software, and the compilation of content (collectively, "ISR Content"), is the property of Island Signal Radio and/or 3ON Entertainment Group and is protected by applicable copyright, trademark, and intellectual property laws. The Island Signal Radio name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of 3ON Entertainment Group. You may not use these marks without the prior written permission of 3ON Entertainment Group.

Restrictions

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without the express written permission of ISR. This includes unauthorized recording, redistribution, rebroadcasting, or retransmission of our live radio stream.

6. Music Submissions & Artist Content

When you submit music, audio content, or related materials ("Artist Content") to Island Signal Radio through our Submit Artist form or any other channel, you agree to the following:

• Ownership & Rights: You represent and warrant that you are the original creator of all submitted content and own or have obtained all necessary rights, licenses, consents, and permissions to submit the content and grant ISR the rights described herein.
• License Grant: By submitting Artist Content, you grant Island Signal Radio a non-exclusive, royalty-free, worldwide license to broadcast, stream, publicly perform, promote, and reference your Artist Content on air, on our website, and across our social media channels in connection with our normal broadcasting and promotional activities. This license is limited to the feature period and any agreed-upon promotional window.
• No Guarantee of Airplay: Submission of music does not guarantee airplay. All submissions are reviewed at the sole discretion of our music directors. ISR reserves the right to decline any submission without explanation.
• Performance Rights: You are responsible for ensuring that all performance rights, mechanical licenses, and related royalties are handled in accordance with applicable laws and your agreements with any performing rights organizations (PROs) such as ASCAP, BMI, SOCAN, or equivalent bodies in your territory.
• Content Standards: All submitted content must comply with applicable laws. Content that is defamatory, obscene, infringing, or otherwise unlawful will be rejected and may be reported to appropriate authorities.

7. Advertising Terms

Advertisers and advertising partners are subject to the following additional terms:

• All advertising content must be truthful, non-deceptive, and comply with applicable advertising laws and standards.
• ISR reserves the right to refuse any advertisement that is misleading, offensive, politically controversial, or inconsistent with our brand values and community standards.
• Payment terms, deliverables, and campaign specifications will be outlined in a separate Advertising Agreement executed between the advertiser and ISR.
• ISR does not guarantee specific results (impressions, clicks, conversions) from advertising campaigns unless expressly stated in a written agreement.
• Refunds for advertising packages are subject to the terms outlined in the executed Advertising Agreement and are not automatic.
• Advertisers are responsible for ensuring their content does not infringe upon any third-party intellectual property rights.

8. Get Featured Terms

Artists and content creators who apply for and participate in ISR's "Get Featured" program agree to the following:

• Feature packages are subject to availability and ISR editorial discretion.
• Payment for feature packages is required prior to the feature being scheduled and produced. Payment terms will be communicated upon application approval.
• Once a feature is confirmed and scheduled, cancellations made less than 7 days before the feature date may be subject to a cancellation fee of up to 50% of the package price.
• ISR will use reasonable efforts to broadcast your feature as scheduled but is not liable for delays caused by technical issues, programming changes, or other circumstances beyond our control.
• Featured artists grant ISR permission to use their name, likeness, biography, and approved promotional materials in connection with the feature, including on our website and social media channels.
• ISR retains the right to archive, replay, and reference feature content for up to 12 months after the original air date for promotional and archival purposes.

9. User-Generated Content

If you submit comments, feedback, social media interactions, or other content in connection with our Service, you grant ISR a non-exclusive, royalty-free license to use, display, and distribute such content in connection with the Service and our promotional activities. You represent that you have the right to submit such content and that it does not violate the rights of any third party.

10. Prohibited Conduct

You agree not to engage in any of the following prohibited activities in connection with the Service:

• Attempting to record, capture, or redistribute our live stream without written authorization
• Using automated tools, bots, scrapers, or spiders to access, collect data from, or interact with our website
• Attempting to gain unauthorized access to any portion of the Service or its related systems
• Uploading or transmitting viruses, malware, or any other malicious code
• Impersonating ISR, 3ON Entertainment Group, or any ISR staff member or representative
• Submitting false, fraudulent, or misleading information through any ISR form
• Using the Service in any way that violates applicable local, national, or international laws or regulations
• Harassing, threatening, or intimidating ISR staff, artists, or other users
• Using the Service to send unsolicited communications (spam)
• Engaging in any conduct that restricts or inhibits any other person's use or enjoyment of the Service

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ISR AND 3ON ENTERTAINMENT GROUP DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ISR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ISR, 3ON ENTERTAINMENT GROUP, THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ISR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of certain damages, ISR's liability shall be limited to the maximum extent permitted by law. In no event shall ISR's total liability to you for all claims arising from or relating to the Service exceed the amount you paid to ISR in the twelve (12) months preceding the event giving rise to the claim, or USD $100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Island Signal Radio, 3ON Entertainment Group, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your use of the Service, (c) your Artist Content or other submissions, (d) your violation of any third party's rights, or (e) your violation of any applicable laws.

14. Termination

ISR reserves the right, at its sole discretion, to terminate or suspend your access to the Service, without notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of a recognized arbitration body, unless otherwise required by applicable law. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief for breach of intellectual property rights or confidentiality obligations.

16. Modifications to Terms

ISR reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by notifying newsletter subscribers. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
